Commercial Photography Agreement & Model Release

1. Payment Terms

Session fees are due on or before the date of the session unless otherwise agreed in writing. No images, including previews, will be delivered until the balance is paid in full. Session fees cover the photographer’s time, travel, setup, and editing. Tangible products (e.g., prints, albums) are not included and must be purchased separately.

Accepted Payment Methods:

  • Check (made payable and mailed to: Emilie Alline Bertolino)

  • Venmo: @EmilieAlline

2. Scope of Services

The Client retains the Photographer to provide commercial photography services at a mutually agreed-upon date, time, and location. Services are considered complete upon delivery of the final edited images as determined by the Photographer.

3. Location Costs & Fees

The Client is responsible for securing and paying for any permits, permissions, entrance fees, or location-related costs required for the session. The Photographer is not responsible for arranging or covering these expenses.

4. Rescheduling & Cancellations

  • Rescheduling requires a minimum of 48 hours’ notice to avoid a rescheduling fee.

  • The Photographer reserves the right to reschedule due to weather, illness, equipment failure, or other circumstances beyond their control.

  • In the event of cancellation, session fees may be credited toward a future session at the Photographer’s discretion and are otherwise non-refundable.

5. Commercial, Editorial & Property Release

The Client grants the Photographer permission to use the photographs for business, promotional, and editorial purposes, including use on the Photographer’s website, portfolio, social media, marketing materials, and publications.

The Photographer grants the Client permission to use the delivered images for commercial and editorial purposes, including marketing, advertising, press, and editorial features related to the Client’s business.

The Client is responsible for obtaining all necessary permissions and signed releases from participants prior to photography, including written consent from a parent or legal guardian for any minor participant. The Client represents and warrants that all necessary permissions and releases have been obtained and will provide documentation upon request.

6. Liability

The Client assumes full responsibility for the safety and conduct of all participants during the session. The Photographer shall not be held liable for any injuries, accidents, or damages occurring during the session.

The Client releases and holds harmless the Photographer from any claims arising from participation in the photography session.

7. Artistic Rights & Deliverables

The Client acknowledges that the Photographer retains full creative and artistic discretion regarding posing, composition, lighting, editing style, and final image selection. Only images that meet the Photographer’s professional standards will be delivered.

The number of final images delivered will vary based on the session scope and is not guaranteed unless otherwise stated in writing.

8. Copyright & Usage

All photographs remain the exclusive property of the Photographer and are protected under U.S. Copyright Law.

Upon full payment, the Client is granted a non-exclusive commercial usage license to use the delivered images for their own business marketing, advertising, and promotional purposes.

9. Minor Participation (If Applicable)

If minors are photographed, a parent or legal guardian must provide written consent prior to photography and confirms they have full authority to provide consent on the minor's behalf.

By signing, the parent or legal guardian:

  • Consents to the minor(s) being photographed

  • Accepts all terms of this Agreement on behalf of the minor(s)

  • Assumes full responsibility for supervision and safety

  • Grants the commercial Model Release outlined in Section 5
